The following is a legal agreement between you and Photography by Jim Christensen. ("Jim Christensen"). Please read this agreement carefully before using any Image. By using any Image, you agree to be bound by the terms of this agreement.

All Images are copyrighted. Photography by Jim Christensen owns all rights to the Images. All rights are reserved by Photography Jim Christensen unless otherwise granted to you. Your rights to use the Image are subject to this agreement and are conditional upon your payment for the Image to Photography by Jim Christensen. If at any time your account becomes delinquent, you relinquish all rights to all Images you have downloaded until all payments and interest are made. Account delinquency will result from bounced checks, unpaid checks, unpaid invoices, and credit card charge backs.

By this Agreement, Photography by Jim Christensen grants you a personal, non-exclusive, non-transferable, right to use and reproduce Images in the following ways:

1. On web sites, multimedia presentations, and broadcast film and video.
2. In magazines, newspapers, books, eBooks, pamphlets, brochures, catalogs, book covers, textbooks, editorials, toolbar skins, posters, mobile phones, greeting cards (paper or online), pagers, CD/DVD cover art, and advertising.
3. In connection with your business identity on letterhead, posters, brochures, or business cards.
4. As decoration in office, restaurant, public area, home, or store.
5. As a single reproduction painted on a canvas to be used as decoration or resold. (Not as a printed reproduction)
6. All other rights in the Images are expressly reserved by Photography by Jim Christensen for itself and on behalf of the respective copyright holders.

You may NOT:

7. Use an Image other than as specified in the preceding section.
8. Use an Image with pornographic, defamatory, or otherwise unlawful or immoral content or in such a manner that it infringes upon any third party's trademark or intellectual property.
9. Use an Image in a way that places a person in the photo in a bad light or depicts them in a way that they may find offensive- this includes pornography, tobacco ads, religious and political endorsements, defamatory, or otherwise unlawful or immoral content.
10. Resell any Image.
11. Share an Image by providing access on shared disk drives or network.
12. Use Photography by Jim Christensen images to compete with Photography by Jim Christensen. This includes, by way of illustration, not by way of limitation, displaying images in any format (including thumbnails) for download on a website. Offering Images for sale, or including Images in templates for sale. You may not, for example, create a greeting card line based on Photography by Jim Christensen images - or use our Images as the basis for a collection of objects for sale. You may use a single image for a greeting card - or a single image for a display or sale item.
13. Use the Image in a website template that you plan to sell or transfer to others.
14. Use any Image as part of a trademark or patent image.
15. Use any Image as part of a logo.
16. Produce printed reproductions of any Image on canvas or paper to be sold.

"Non-transferable" as used herein means that except as provided in this EULA, you may not sell, rent, load, give, sublicense, or otherwise transfer to anyone the Image or the right to use the Image. In addition, the work you produce with the Image must be used for your direct employer, client, or customer, who must be the end user of your work. You agree to take all commercially responsible steps to prevent third parties from duplicating any Image. This may include identifying that Photography by Jim Christensen owns the image on the document you intend to use the Image.

You agree to indemnify and hold Photography by Jim Christensen, Inc., its officers, employees, shareholders, directors and suppliers harmless against any damages or liability or any kind arising from any use of the Image other than the uses expressly permitted by this Agreement.

Neither Photography by Jim Christensen or any of its directors, officers, employees, partners, licensors, or agents shall be liable for any damages, whether direct, indirect, consequential, or incidental, arising out of the use of, or the inability to use, any Image or Images.

This Agreement shall be governed by the laws of the State of Oregon. The venue of any action respecting this Agreement, any Image, or use thereof, shall be in the county of Multnomah and not elsewhere.

Additional rights to Images are available. If you are unsure of your rights under this agreement, or if you wish to use an Image in a matter not expressly permitted under this agreement, please contact Photography by Jim Christensen.

Photography by Jim Christensen makes no representations or warranties whatsoever as to the legality or validity of any Release associated with an Image.

Photography by Jim Christensen makes no representations or warranties whatsoever with respect to the use of names, trademarks, logos, uniforms, registered or copyrighted designs or works of art depicted in any Image.

You must satisfy yourself that all necessary rights, consents or permissions as may be required for Reproduction of any Image have been secured by you.
